I acknowledge that by participating in the Torbay Half Marathon or 10k (known as Event), I agree to the terms and conditions below and the following disclaimer:

I hereby:

  1. agree that any participation by me in the Event is solely and entirely at my own risk and (to the extent permitted by law) no person(s) or organisation(s) shall be liable for any accident, harm, injury, loss or damage to property, however so caused, arising out of or in connection with or, suffered during or as a result of, my participation in the Event, provided always that nothing shall exclude liability for death or personal injury caused directly by the negligence of the organiser or its employees;

  2. consent to medical assistance and/or medical care being given to me in the case of illness, injury or an emergency situation, should this occur during the Event, such assistance to be given by the organiser, its employees, contractors or other trained personnel conducting the Event (which may include the use of anaesthetics);

  3. acknowledge and agree that: 

-running is an endurance sport;

-I should only undertake such an activity to a level which reflects my level of fitness;

-I am responsible for monitoring my own physical condition prior to and during participation in the Event;

-understand the importance, for safety reasons, of obeying the rules, guidelines and instructions given by the Event organiser’s officials, stewards, nominated representatives and other authorised personnel and hereby agree to abide by the same and to behave responsibly at all times during the Event and be mindful of the impact of my actions on others; and

  1. agree that my participation in the Event is for recreational and/or charity fundraising purposes only and I will not participate in the Event for any commercial or business purpose. The Event organiser will have no liability to the Participant for any loss of profit, loss of business, business interruption, or other loss of business opportunity.

5. In no event shall the Event organisers be liable to you whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with these terms of entry or in connection with the event for any:

loss or damage, profit, reputation, business, revenue or goodwill, anticipated savings; pledges made on your behalf or by you to charity; or consequential or indirect loss regardless of whether the loss or damage: (a) would arise in the ordinary course of events; (b) is reasonably foreseeable; or(c) is in the contemplation of the parties, or otherwise. Nothing in this agreement shall affect our liability for death or personal injury, fraud, or any other liability to the extent it cannot be excluded or limited by law.

Terms and conditions of entry

By entering the event you are agreeing to abide by these terms and conditions and any race instructions given to you by the organisers and officials of the event. 

  1. Condition of entry: you agree to abide by these race rules and the rules of competition as laid down by UK Athletics. This event operates under Licence from UK Athletics and its competition rules will apply. Entrants must be aged 17 years over for the half marathon and age 15 or over for the 10k on the day of the event. Under 18's must have parental/guardians permission to enter.

  2. Closing Date: for entries will be midnight 21st June 2023 or earlier if the race limit is met. No late entries or transfers on the day.

  3. Entry to this race: is personal to each applicant. Once you have paid for your entry there can be no refund if you are subsequently unable to take part. Entries cannot be carried forward. A runner who competes unofficially with another person's race number will be disqualified.

  4. You can transfer your entry to another runner up to midnight on 21st June 2023. If a participant transfers their entry to another runner after midnight 12th June 2023 it is their responsibility to pass on the race pack- that is posted to original address- to the new, transferred runner. We will not be providing spares on race day.

  5. Entrants to this event undertake not to take part unless they are medically fit to run and able to complete the half marathon course under 3.5 hours. And the 10k under 2 hours . All competitors will need to complete the first lap under 2 hours to continue.

  6. We reserve the right: to refuse or cancel applications, including duplicate applications, or alter the date of the event, the fees charged, the course route, distance or prizes and any aspect of the event management.

  7. Change of address: if you change your address/email address or anticipated finish time you must amend your details via the registration portal. 

  8. Race numbers must be pinned securely to the front of your running top using a safety pin in each corner you must not cut, fold or otherwise alter the size of your race number in any way.

  9. All runners are required to complete the contact and medical details when registering. This is a requirement of participation and may be checked by race officials prior to the start.

  10. Your timing chip is attached to the back of your race number and is disposable; your race number must be attached to the front of your running top with a safety pin in each corner – please make sure you do not perforate the timing chip with the pin. Also do not bend or fold the timing chip as this could damage its ability to time you. There will be no other timing system on the day.

  11. The Half Marathon Course is a 2-lap race and the 10k runners will run one lap of the course. Slower runners are required to move over and stay on the left hand side of the road once the elite athletes start to overtake. The Torbay Half Marathon is a running race and we have set a time limit of 3 hours 30 minutes for the 13.1 mile course. All competitors will need to complete the first lap of the half marathon under 2 hours to continue.

  12. In the interests of everyone's safety, please don’t use in-ear headphones. Torbay Half Marathon is a 2-lap course and most runners will be lapped by the lead runners overtaking from behind running faster than you. We therefore need our runners to be able to hear our marshal’s safety instructions as the lead runners and the escorts approach. You will not be able to hear them if you are using in-ear headphones. Anyone using in-ear headphones during the event will be disqualified. Only bone-conducting headphones that work from outside the ear are approved by UKA. It’s really important that you hear what’s going on around you.

  13. Race marshals and medical team members have the authority to disqualify and remove any runner they consider to be acting dangerously, or to be unfit to compete.

  14. Runners are required to report any casualties immediately to the nearest first aid post or race marshal.

  15. Wheeled vehicles: dogs or following cycles are not permitted. All competitors must compete on foot. Roller skates etc are prohibited. The course is not suitable for wheelchairs. Guide dogs are only permitted via prior agreement with race organisers.

  16. Race packs: We will be sending out race packs containing your race number and timing chip from 3 weeks before the event.

  17. The Torbay Half Marathon complies with the Data Protection Act. By entering the run you give permission for free use of your name, voice or image in any broadcast, advertising promotion or other account of this event including race results. Your name will be added to the organiser’s mailing list so that we can keep you informed about other events and activities of the event organiser.

  18. Covid-19. By entering participants agree to follow all social distancing protocols as requested by the race organiser at all times and agree to wear a facemask when in the start/finish area, plus any other reasonable requests made by the organisers. Should the pandemic force cancellation participants will be offered a transfer to a new event date. Should a refund be offered this will be minus any website processing/admin fees.   19. The organisers reserve the right to refuse an entrant’s attendance at or participation in the event or any future event. Any participant who is found in breach of these terms and conditions may be excluded from future events.

  20. I understand and accept that the organisers reserve the right to cancel the race if adverse weather should make conditions too dangerous for competitors, or a serious incident occurs that prevents the race going ahead. In this event, there will be NO REFUNDS OR ENTRY DEFERRALS.

  21. I also accept that if I am entering this race on behalf of another person, I am authorised by them to accept these Terms and Conditions on their behalf.
